Nuisance Complaints What is a Nuisance?

The law says something is only a nuisance when it is excessive and unreasonable.

Just because you hear noise, this does not necessarily make it a 'nuisance'. We all have to put up with some noise from other people's activities. In legal terms, temporary or trivial matters are not considered a nuisance.

What can I do if I have a problem?

If possible, talk to the person causing the problem. Tell them to stop or moderate their behaviour. Remember that your neighbour may not be aware they are upsetting you.

If this does not work, write your neighbour a polite note, again, asking them to stop or moderate their behaviour. Make sure you keep a copy of the note.

What should I do next?

If you cannot solve the problem by talking to your neighbour. We may be able to help.
  • If your complaint is against an owner-occupier, the tenant of a private landlord or housing association, contact your Housing Officer who will advise you what action is possible.
  • If your complaint is against another Tenant of Pennine Housing 2000, we may be able to take action for you under the Tenancy Agreement.
