NEIGHBOUR NUISANCE DIARY
How to complete the Diary Sheets

We hope to solve most disputes without taking serious action. However, if the situation is bad enough, we will use the law to force those who are acting anti-socially to stop, or even to evict them.

To take legal action we need a carefully written down description of every incident. A court will only accept this incident diary if it is written in a certain way, so please keep to these three simple rules when completing the diary:

  1. The diary is YOUR OWN PERSONAL ACCOUNT of what you see or hear. You can't write down something that other people (including people you live with) have witnessed. They must complete their own diary sheets.
  2. You must fill in the diary AS SOON AS POSSIBLE while the incident is still fresh in your mind. Do it on the same day if you can. If you leave it much longer a court might not accept it.
  3. WRITE DOWN EVERYTHING you see and hear in as much detail as possible. A general summary isn't taken seriously by the court as word-for-word evidence. You should include swear words as you hear them, rather than putting "he/she used abusive language". This may be upsetting but exact wording is more effective.Name the people who do or say something.Avoid putting 'he said....' or 'she did....' because this may be questioned later. Use additional sheets if necessary (please ensure you sign and date them)
